## PREAMBLE

Bluprint is a free-to-use tool, provided by Blubyte nv, designed as an easy-to-use drawing aid for NetScaler-related network diagrams. It allows a user (the "User") to create a diagram and share it with others by means of a unique link. Bluprint is not intended, and must not be used, as a general-purpose storage, messaging, backup, or file-sharing service. By accessing or using Bluprint, the User accepts this Fair Usage Policy and the accompanying Disclaimers (together, the "Policy"). If a User does not agree with this Policy, they must not use Bluprint.

This Policy should be read alongside Blubyte's general [Terms & Conditions](https://www.blubyte.eu/terms) and [Privacy Policy](https://www.blubyte.eu/privacy), which apply to the extent relevant and are not contradicted by the specific provisions below. In the event of a conflict between this Policy and Blubyte's general Terms & Conditions with respect to Bluprint, this Policy shall prevail.

## ARTICLE 1 — HOW BLUPRINT WORKS (AND WHY IT MATTERS FOR THIS POLICY)

Bluprint is designed as a zero-knowledge, end-to-end encrypted, anonymous tool:

- Diagram data is encrypted in the User's browser before it is ever transmitted to Blubyte's servers.

- The decryption key is embedded in the URL fragment (the part after the `#` symbol). By technical design, the URL fragment is never sent to or stored by the server — it stays on the User's device and any system it is subsequently shared through (e.g. copy-paste, chat, email).

- As a direct consequence, Blubyte cannot read, recover, moderate, filter, or restore the content of any Bluprint link. Blubyte only ever stores encrypted, unreadable data.

- No account, registration, or identifying information is required or requested to use Bluprint. Blubyte does not knowingly link diagram data to an identifiable User (see Article 4).

This architecture is the foundation of Bluprint's privacy design, but it also defines the practical and legal limits of what Blubyte can guarantee, as set out below.

## ARTICLE 2 — FAIR USAGE POLICY

### 2.1 Intended Use

Bluprint is intended solely as a drawing aid for creating and sharing NetScaler-related network diagrams (e.g. topology overviews, HA/GSLB setups, traffic-flow schematics, architecture sketches). It is built for that purpose, and its design, limits, and support are optimised accordingly.

Bluprint is not intended to be used as:

- A general-purpose note-taking, messaging, or credential-sharing tool;

- A file-storage, backup, or archival service; or

- A repository for information unrelated to network/infrastructure diagramming.

Users agree to use Bluprint only for its intended purpose, only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use of Bluprint by, any third party.

### 2.2 Prohibited Use

Because Blubyte cannot inspect the content of encrypted links, Users bear full responsibility for what they create and share via Bluprint. Regardless of intended purpose, Users must not use Bluprint to create, store, or distribute content that:

- Is illegal under the laws applicable to the User or Belgium;

- Infringes the intellectual property, privacy, or other rights of any third party;

- Contains malware, exploit code, phishing content, or is intended to facilitate unauthorised access to third-party systems;

- Constitutes child sexual abuse material, terrorist content, hate speech, or content that incites violence;

- Is used to circumvent export control, sanctions, or other regulatory restrictions; or

- Is used for spamming, mass-distribution, or automated/bulk creation of links outside normal, incidental human use.

Users must not use Bluprint to store or transmit sensitive information unrelated to diagramming, such as passwords, credentials, personal data, or confidential business documents. Bluprint's encryption is a security feature of the diagramming tool, not an invitation to repurpose it as a general secrets vault.

### 2.3 Best-Effort Availability and Link Retention

Bluprint is offered as a free, best-effort utility rather than a guaranteed storage service. Users acknowledge and accept that:

- Links older than approximately one (1) year may be removed at Blubyte's discretion, without prior notice;

- Links, and the diagrams behind them, may disappear at any time as a result of platform upgrades, migrations, infrastructure changes, or maintenance, even before any stated retention period has elapsed;

- Blubyte does not guarantee the long-term or permanent availability of any link, and makes no commitment to notify Users before a link is removed or becomes inaccessible.

Because of this, Bluprint provides the ability to export a diagram's underlying details in JSON format, which Users can download and store on their own systems. Users who wish to retain a diagram beyond the short term are strongly encouraged to export and keep their own local copy. Blubyte holds no responsibility for diagrams that are lost, deleted, or become inaccessible because a User did not export and separately retain their own copy.

Blubyte may additionally apply reasonable technical limits (e.g. maximum diagram/file size, rate limits on link creation, or throttling of automated/abusive traffic) to keep the Service available and performant for all Users.

### 2.4 Enforcement

Because Blubyte cannot see the contents of a link, enforcement of Article 2.2 will typically only occur based on reports from third parties (e.g. abuse reports, legal requests) referencing a specific link or timeframe — not based on content review. Where Blubyte has reasonable grounds to suspect a link is being used in violation of this Policy, Blubyte may disable or delete the affected link and, where legally required, cooperate with competent authorities. Blubyte is under no obligation to monitor, and does not monitor, the content passing through Bluprint.

## ARTICLE 3 — DISCLAIMERS

### 3.1 "As Is" Service

Bluprint is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted and error-free operation.

### 3.2 No Access to Content — No Recovery of Lost Keys or Removed Links

Because the decryption key never reaches Blubyte's servers, and because Bluprint is a best-effort service (see Article 2.3):

- Blubyte cannot decrypt, read, moderate, back up, or recover any content shared via Bluprint.

- If a User loses or fails to properly transmit the full link (including the `#key` fragment), or if the link is removed or becomes inaccessible (e.g. due to age, an upgrade, or migration), the underlying diagram data is permanently and irretrievably lost. Blubyte has no technical means to reset, restore, or reissue a decryption key, and cannot recreate a removed or lost link.

- Blubyte shall not be held liable for any loss resulting from a lost, mistyped, truncated, expired, or removed link, or for a User's failure to export and separately store their diagram in JSON format as described in Article 2.3.

- Users are solely responsible for transmitting links securely and only to their intended recipients. Blubyte is not responsible for any consequences arising from a link being intercepted, forwarded, or accessed by an unintended party after it leaves the User's control.

### 3.3 No Liability for Content

Blubyte acts solely as a technical intermediary providing encrypted storage and transport infrastructure for diagrams. Blubyte:

- Does not create, select, initiate, modify, or endorse the content shared via Bluprint;

- Has no knowledge of, and no ability to review, the content of any link; and

- Disclaims all liability for the legality, accuracy, completeness, or consequences of any content shared by Users, which remains the sole responsibility of the User(s) involved.

### 3.4 Best-Effort Availability, Technical Interruptions, and Right to Change or Discontinue the Service

Bluprint is provided free of charge on a best-effort basis. Blubyte does not guarantee uninterrupted, secure, or error-free access, and does not guarantee that any link will remain available for any minimum period. Without limiting Article 2.3:

- Blubyte may suspend, restrict, modify, or discontinue Bluprint, in whole or in part — including changing its features, scope, or nature — at any time and at its sole discretion, without any obligation to provide prior notice to Users.

- Blubyte is not liable for any damage resulting from unavailability, downtime, discontinuation, removed or expired links, or data loss arising from platform upgrades, migrations, or the retention limits described in Article 2.3.

Users who depend on a given diagram remaining accessible are responsible for exporting and independently storing it in JSON format, as Bluprint itself is not a guaranteed long-term storage solution.

### 3.5 Security of Transmission and Endpoints

End-to-end encryption protects the content while it is stored on and transmitted through Blubyte's infrastructure. It does not protect against:

- Compromise of the User's own device, browser, or network;

- Malware, keyloggers, screen capture, or shoulder-surfing on either end;

- A User voluntarily sharing the full link (including the key) with unintended parties;

- Interception at any point once the link leaves the User's control (e.g. a public or unencrypted channel used to send the link itself).

Users remain responsible for the security of the devices and channels they use to access and share Bluprint links.

### 3.6 Not a Substitute for Storage, Backup, or Sensitive-Data Handling

Bluprint is a narrowly-scoped diagramming aid, not a storage, backup, or secrets-management platform. Unless expressly agreed otherwise in writing with Blubyte:

- Bluprint should not be relied upon as a durable or long-term storage location for any diagram or data — see Article 2.3 on best-effort availability and the JSON export option; and

- Bluprint should not be used to transmit data subject to heightened regulatory, contractual, or classification requirements (e.g. special categories of personal data under the GDPR, classified information, regulated financial or health records, or credentials), where a dedicated, contractually governed solution is required.

### 3.7 Limitation of Liability

To the maximum extent permitted by applicable law, and consistent with Article 19 of Blubyte's general Terms & Conditions:

- Blubyte shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, loss of opportunity, or reputational harm, arising out of or related to the use of Bluprint;

- Where Bluprint is provided free of charge, Blubyte's aggregate liability for any direct damages arising from the use of Bluprint shall be limited to the greater of (i) EUR 100, or (ii) any amount actually paid by the User for the use of Bluprint in the twelve (12) months preceding the event giving rise to the claim, where applicable.

Nothing in this Policy limits liability that cannot be excluded or limited under mandatory applicable law (e.g. liability for wilful misconduct or gross negligence).

## ARTICLE 4 — ANONYMOUS USE & DATA PROTECTION (GDPR)

Bluprint can be used anonymously. No account, registration, name, or email address is required to create or view a diagram. Blubyte does not knowingly collect or require identifying information from Users in order to provide the Service.

Blubyte may nonetheless process limited technical and metadata information (such as IP address, timestamps, and the encrypted payload itself) as strictly necessary to operate, secure, and maintain Bluprint, in accordance with Blubyte's general [Privacy Policy](https://www.blubyte.eu/privacy) and Regulation (EU) 2016/679 (GDPR). Because Blubyte cannot access the decrypted content of a link, Blubyte cannot identify, and is not aware of, the nature of any information a User chooses to include within a diagram.

Users must not use Bluprint's diagrams to include personal data of third parties (see Article 2.2). To the extent a User nonetheless includes such data, that User acts as the data controller for that data and is solely responsible for ensuring a lawful basis for doing so.

## ARTICLE 5 — GOVERNING LAW & DISPUTES

This Policy is governed by Belgian law. The parties will attempt to resolve any dispute relating to Bluprint amicably. Failing an amicable resolution, disputes shall be brought before the competent courts of Brussels, without prejudice to any mandatory consumer-protection rules applicable to the User's place of residence.

## ARTICLE 6 — CHANGES TO THIS POLICY

Blubyte may amend this Policy from time to time to reflect changes to Bluprint, legal requirements, or operational practice. The updated version will be published on this page with a revised "Last updated" date. Continued use of Bluprint after such changes constitutes acceptance of the revised Policy.
